Yes. The number of justices for the Supreme Court is set by
Congress. In establishing a Supreme Court, the Judiciary Act of 1789 provided
one Chief Justice and five associate justices. After the Civil War, Congress
expanded the Court to its present number of nine justices. If Republicans win
the White House and 60 Senate seats, it is possible that they will expand the
Court to—say, 11—, pack the Court with justices similar to Scalia, and render
moot the votes of the four liberal justices.
